I am a bit surprised this came up again. Months back a well known agent did that with digital rights for some of his clients (books were published before digital rights existed and it wasn't in the withstanding contracts). Publishers got into a snit over it and he eventually backed down. I believe, but I'm not 100%, that he negotiated the ebook rights with those publishers.

Wish I could remember the agent's name. It can probably be found with a bit more research.
